TraceWay Terms of Service

Introduction
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Kevin Xia (“Developer,” “we,” “us,” or “our”) governing your access to and use of the TraceWay mobile application (“Application”) distributed through the Apple App Store.
By downloading, installing, or using TraceWay, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the Application.
Apple App Store Terms
Your use of the Application is also subject to the Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement (“Apple EULA”). In the event of any conflict between these Terms and the Apple EULA with respect to the Application, the Apple EULA shall govern. Apple is not a party to these Terms and is not responsible for the Application or its content.
License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on an Apple-branded device that you own or control, solely for your personal, non-commercial purposes.
Restrictions on Use
You agree that you will not:
- Use the Application for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to reverse-engineer, decompile, disassemble, or derive source code from the Application.
- Modify, adapt, translate, or create derivative works based on the Application without our prior written consent.
- Redistribute, sublicense, sell, rent, lease, or transfer the Application or any rights therein to any third party.
- Use the Application in any manner that could damage, disable, overburden, or impair its functionality.
Intellectual Property
The Application, including all software, design, graphics, text, and other content, is the exclusive property of Kevin Xia and is protected by applicable intellectual property laws. All rights not expressly granted to you under these Terms are reserved by us. Nothing in these Terms shall be construed as conveying to you any intellectual property rights in or to the Application.
Disclaimer of Warranties
THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Application will be uninterrupted, error-free, or free of harmful components.
- Location data recorded by the Application will be accurate, complete, or suitable for any particular purpose, including navigation.
- Any defects in the Application will be corrected.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KEVIN XIA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (I) YOUR USE OF OR INABILITY TO USE THE APPLICATION; (II) ANY INACCURACY IN LOCATION DATA RECORDED BY THE APPLICATION; OR (III) ANY OTHER MATTER RELATING TO THE APPLICATION.
Our aggregate liability to you for any claims arising out of or relating to the Application shall not exceed the amount you paid for the Application, if any.
Indemnification
You agree to defend, indemnify, and hold harmless Kevin Xia from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Application or your violation of these Terms.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with the Apple EULA and our Privacy Policy, constitute the entire agreement between you and Kevin Xia with respect to the Application and supersede all prior agreements and understandings.
Changes to These Terms
We reserve the right to modify these Terms at any time. Any changes will be effective upon posting the updated Terms, reflected by an updated “Last Updated” date. Your continued use of the Application following the posting of revised Terms constitutes your acceptance of the changes.
